ABC Salon System Terms & Conditions

Welcome to the ABC Salon Solution, LLC (referred to as “ABC Salon System”) digital platform. This agreement covers your access to our hardware, software, advertising, and information resources (collectively, our “Site”). The words “you” and “your” refer to you, your employees, affiliates, subsidiaries, and legal guardians.

1. Acceptance of Agreement

By accessing our Site, you agree to comply with this User Agreement and all incorporated policies. If you purchase specific services, additional agreements may apply. In the event of a conflict, the service-specific agreement will take precedence.

2. Age Requirements & Eligibility

You must be at least 13 years old to use our Site. Users between 13 and 18 require legal parental or guardian consent. By using this Site, you confirm you meet these age requirements and possess the legal capacity to enter into this agreement.

3. Modifications to Agreement

We reserve the right to update this agreement at any time without direct notice. Changes are effective immediately upon posting. Your continued use of the Site signifies your acceptance of the new terms. We may also modify or discontinue the Site at any time without liability.

4. Account Security & Registration

When creating an account, you agree to provide accurate and up-to-date information. You are fully responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately of any security breaches. We reserve the right to suspend accounts with fraudulent information or to take actions necessary to protect Site security.

5. Data Privacy

Your use of the Site is governed by our Privacy Policy, which details how we collect and use your data. By using the Site, you consent to these practices.

6. Intellectual Property & Trademarks

All content, hardware designs, software, custom graphics, and logos are owned by ABC Salon System Intellectual Property or its affiliates. You may not copy, modify, or use our trademarks, service marks, or proprietary content without prior written permission.

7. Copyright Claims (DMCA)

We respect intellectual property rights. If you believe your work has been infringed upon, please send a written notice to our Copyright Agent at 2909 E Arkansas Ln, Arlington, TX 76010 or email info@abcsalonsystem.com. Include your signature, a description of the copyrighted work, its location on our Site, your contact information, and a statement made under penalty of perjury regarding your good-faith belief of the infringement.

8. Accuracy of Information

We strive for accuracy but do not guarantee that product descriptions, pricing, or other content are error-free. We reserve the right to correct errors and cancel orders if necessary.

9. Returns & Exchanges

Hardware may be returned within 30 days of purchase for a full refund (excluding shipping).

  • Hardware carries a one-year manufacturer’s warranty against defects (excludes water damage, normal wear, or negligence).

  • Returned items must be in like-new condition with all original packaging.

  • You are responsible for prepaid, trackable return shipping costs.

  • Ship returns to: ABC Salon System Returns Center, 2909 E Arkansas Ln, Suite A, Arlington, TX 76010.

10. Ordering & Subscriptions

We reserve the right to limit quantities or reject orders to prevent fraud. Approved orders placed before 4:00 PM CST on business days (Monday-Friday, excluding holidays) will ship the following day.

11. Permitted Use & Restrictions

You agree to use the Site legally. You will not engage in the following prohibited activities:

  • Posting unlawful, abusive, defamatory, or obscene content.

  • Infringing on intellectual property rights.

  • Distributing malware, viruses, or disruptive code.

  • Sending unsolicited advertising or spam.

  • Using automated tools (robots, spiders) to scrape data.

  • Reproducing or reselling any portion of the Site for commercial purposes.

  • Reverse-engineering our underlying software or technology.

12. User-Generated Content

You are solely responsible for the notes, text, or data you enter into the system. You agree not to enter defamatory content, violate privacy rights, expose Personally Identifiable Information (PII), or break any local, state, or federal laws. We do not endorse or assume liability for your generated content.

13. System Security

Violating our network security is strictly prohibited and may result in criminal prosecution. Do not probe system vulnerabilities, forge headers, or attempt to overload our servers.

14. Regional Access

This Site is intended for users within the United States. We make no guarantees that our products or services are appropriate or available for international use.

15. Data Storage & Limits

We may establish limits on how you use the Site, including data storage caps and message limits. We are not responsible for the deletion or failure to store your communications and reserve the right to terminate inactive accounts.

16. Disclaimer of Warranties

Your use of the Site is at your own risk. The Site and its services are provided “as is” without any warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. We do not guarantee uninterrupted, secure, or error-free service.

17. Policy Enforcement

We reserve the right to strictly enforce this agreement through warnings, account suspension, or legal action. We may disclose your information to law enforcement or third parties to protect our rights, collect for services, or comply with legal obligations.

18. Limitation of Liability

ABC Salon System is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Site. This includes lost profits, lost data, or damages caused by third parties, even if we were advised of the possibility. Where jurisdictions do not allow absolute exclusions, our aggregate liability shall not exceed one thousand dollars ($1,000).

19. Indemnification

You agree to defend and hold ABC Salon System harmless from any claims, damages, or legal fees arising from your use of the Site, your generated content, or your violation of these terms.

20. Account Termination

We may suspend or terminate your account without notice for violating this agreement, illegal activities, extended inactivity, or at the request of law enforcement. Termination may result in the deletion of your account data and restricted access to the Site.

21. General Provisions

Failure to enforce any part of this agreement does not constitute a waiver of our rights. If any provision is deemed unenforceable, the remaining provisions remain in full effect. This agreement is governed by the laws of the State of Texas, and any legal action must be brought exclusively in the courts of Texas.
